Terms & conditions

Welcome to American Additive Manufacturing LLC (“we,” “us,” or “our”), a 3D printing company based in Pennsylvania. Please read these Terms of Service (“Terms”) carefully, as they govern your access to and use of our website www.americanadditive.com (“Site”) and our services, including but not limited to 3D printing, design assistance, and file hosting (collectively, the “Services”). By accessing or using our Site and Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not access or use our Site or Services.

1. Eligibility

By accessing or using our Site and Services, you represent and warrant that you are at least 18 years old, or if you are under the age of 18, you have the consent of your parent or legal guardian. You must not use our Site or Services if you are prohibited from doing so by applicable law or regulation.

2. Accounts

To access certain features of our Site and Services, you may be required to create an account. When you create an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You accept responsibility for all activities that occur under your account.

3. Quotes, Orders, and Manufacturing Services

Information on our Site, including descriptions of our capabilities, materials, and past work, is provided for general informational purposes and does not constitute an offer to sell or a binding commitment. Pricing, lead times, and specifications are estimates until confirmed in a written quote.

Any quote you request, purchase order you submit, and manufacturing, engineering, or related services we provide are governed by our separate Quote Terms and Purchase Order Terms, in addition to any signed agreement between us. To the extent those terms conflict with these Terms regarding the purchase of goods or services, the Quote Terms, Purchase Order Terms, or signed agreement control.

4. Privacy

Our Privacy Policy explains how we collect, use, and disclose information about you when you use our Site and Services. By using our Site and Services, you acknowledge that you have reviewed our Privacy Policy, which is incorporated into these Terms by reference.

5. Intellectual Property

All content on our Site, including but not limited to text, images, graphics, logos, and software, is the property of American Additive Manufacturing LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works from such content without the express written permission of American Additive Manufacturing LLC or its content suppliers.

6. User-Generated Content

You retain ownership of any intellectual property rights in the content you upload to our Site, such as 3D models, designs, and images (“User Content”). By uploading or submitting User Content to our Site, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display the User Content in connection with our Site and Services. This license continues even if you stop using our Site and Services.

You represent and warrant that:

  • You own or have the necessary rights and permissions to upload and use the User Content on our Site and Services.
  • The User Content does not infringe any third-party intellectual property rights, such as copyrights, trademarks, or patents.
  • The User Content does not violate any applicable laws or regulations, including but not limited to privacy, export control, or obscenity laws.

7. Feedback

If you send us feedback, suggestions, or ideas about our Site, Services, or business, you agree that we may use and implement that feedback without restriction or obligation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose.

8. Export Control and Controlled Data

Our Site and Services are operated from the United States and are subject to U.S. export control and economic sanctions laws, including the International Traffic in Arms Regulations (ITAR), the Export Administration Regulations (EAR), and regulations administered by the U.S. Office of Foreign Assets Control (OFAC).

By submitting files or technical data to us, you represent and warrant that you are authorized to disclose that information to us and that doing so does not violate any export control law or third-party obligation. You must not upload or transmit ITAR- or EAR-controlled technical data through the Site without first making appropriate written arrangements with us, and you must clearly identify any controlled information before transmitting it.

You represent that you are not located in, and are not a national of or controlled by, any country or party subject to U.S. embargo or sanctions, and that you will not use our Site or Services in violation of applicable export control or sanctions laws. We may restrict access to controlled technical data to authorized U.S. persons and may decline to receive or process any information we cannot lawfully handle.

9. Prohibited Content and Conduct

You agree not to upload, post, or otherwise transmit any User Content that:

  • Violates or infringes upon the rights of others, including copyrights, trademarks, patents, or trade secrets.
  • Is harmful, threatening, abusive, harassing, defamatory, invasive of privacy, or otherwise objectionable.
  • Promotes or encourages illegal activities, such as copyright infringement, hacking, or drug use.
  • Contains malware, viruses, or any other harmful or potentially harmful components.

10. Copyright Complaints (DMCA)

We respect the intellectual property rights of others and expect our users to do the same. If you believe content on our Site infringes your copyright, please send a written notice to our designated contact that includes: (i) your physical or electronic signature; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the material claimed to be infringing and its location on the Site; (iv) your contact information; (v) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

11. Third-Party Links and Services

Our Site may contain links to third-party websites, resources, or services that we do not own or control. We provide these links for convenience and do not endorse and are not responsible for the content, products, or practices of any third party. Your use of third-party websites and services is at your own risk and subject to their terms and policies.

12. No Professional Advice

Content on our Site, including articles, guides, material data, and design-for-additive-manufacturing information, is provided for general informational purposes only and is not engineering, professional, or legal advice. You are responsible for evaluating the suitability of any information, material, or process for your specific application and for ensuring your parts and programs meet all applicable requirements.

13. Modifications to and Availability of the Site

We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We do not guarantee that the Site will be available, uninterrupted, or error-free, and we are not liable for any unavailability or for any modification or discontinuation of the Site.

14. Termination

We reserve the right to terminate your access to our Site and Services at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, you must cease all use of our Site and Services and destroy any materials obtained from our Site or Services.

15. Disclaimer of Warranties

Our Site and Services are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Site or Services will be uninterrupted, error-free, or completely secure. You use our Site and Services at your own risk.

16. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall American Additive Manufacturing LLC, its officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of our Site or Services, even if we have been advised of the possibility of such damages.

17. Indemnification

You agree to indemnify, defend, and hold harmless American Additive Manufacturing LLC, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to your use of our Site or Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

18. Governing Law and Dispute Resolution

These Terms and your use of our Site and Services will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of our Site or Services shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration proceedings to be held in the Commonwealth of Pennsylvania. You agree that any claim you may have arising out of or related to these Terms or your use of our Site or Services must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred.

19. Changes to These Terms

We reserve the right to modify these Terms at any time, at our sole discretion. If we make changes to these Terms, we will post the revised Terms on our Site and update the “Last Updated” date at the top of this page. Your continued use of our Site and Services after we have posted the revised Terms constitutes your acceptance of the revised Terms.

20. Miscellaneous

These Terms constitute the entire agreement between you and American Additive Manufacturing LLC concerning your use of our Site and Services and supersede all prior agreements, understandings, and communications, whether written or oral. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
